Thunder and Lightning provides this web site for the use of its customers and members of the general public subject to the following terms of use. If you do not agree to accept these terms then do not use this web site.

Requests for information must only be submitted to Thunder and Lightning by the person requesting the information and not on behalf of any other person.

The use of this web site is subject to Thunder and Lightning's Privacy Policy.

Whilst Thunder and Lightning has tried to ensure the validity of the information included on this web site Thunder and Lightning does not warrant or make any representations regarding the use, validity, accuracy or reliability of the information provided or the results of its use.

Thunder and Lightning is not liable for any damages of any kind arising out of, or relating to the, use of this web site. Thunder and Lightning may change these terms of use by revising this posting. By using this web site you agree to be bound by such revisions, and you agree periodically to visit this page to determine the current Terms of Use to which you are bound.

These Terms of Use are to be interpreted, construed and enforced in accordance with the laws of England, and you and Thunder and Lightning irrevocably submit to the non-exclusive jurisdiction of the English Court.

 

TRADING TERMS & CONDITIONS


Definitions

1. Agreements

1.1
By signing the order form or asking us to proceed with the work detailed within the quote, a binding agreement will come into place, which cannot be cancelled without consent from both client and us.

1.2
This agreement is governed by English Law so that disputes can only be settled within English Courts.

1.3
This Agreement constitutes the entire agreement between the parties with respect to all matters referred to herein and supersedes all earlier warranties, representation or statements made by the parties (whether orally or in writing).

 

2. Payment Terms and Agreement

2.1
This agreement is to pay for an order in accordance with Thunder and Lightning’s simple three stage
payment terms, consisting of a 30% deposit with the order, a 30% payment on the first day of production and 40% payment on delivery or completion of works and no later than 30 days after this point. Work on a project can only commence once the deposit has been paid. A project is considered complete if delivery of client-supplied content is preventing completion of the project.

2.2
The second stage invoice will cover the production part of the project, with the final stage fee to include
any additional fees or expenses accrued during the project duration. This will include shoot travel costs, accommodation and sundries as well as extra production and studio time over and above the agreed rate at project start.

2.3
Where payment is not made, interest is chargeable on outstanding balances at a rate of 2% per month
unpaid.

2.4
Acceptable payment methods are by bank transfer or BACS.

2.5
Any additional work requested on the project once the second stage invoice has been issued will be re-quoted as a separate project and the above three stage invoice process will apply.

2.6
The project start date is deemed once a signed order confirmation has been received, from which the
cancellation policy will apply. On cancellation at any point of the project after this date, the paid deposit will be retained. If the project is cancelled by the client during the commencement of the project after any aspect of the work has been carried out, the client will be liable to pay for the daily ratable amount of work completed minus the deposit already paid.

2.7
An additional cancellation policy applies to live shoot dates. If a shoot date is cancelled or postponed
by the client less than 24 hours prior to the shoot, the client is liable to pay the total rate for the shoot.

 

3. Ownership

3.1
All goods provided or delivered as a result of this order will remain the property of Thunder and
Lightning Films Limited until payment is received and cleared in full.

3.2
Once the project has been signed off and full payment has been received, Thunder and Lightning will retain and archive all project footage, assets and documentation for a period of two years, after which the footage may be deleted. Any footage or assets can be released and retrieved at any time in this period for use by the client. Any time spent collating, retrieving and transferring footage or assets will be charged at an hourly studio rate.

 

4. Copyright

4.1
Thunder and Lightning will retain copyright on all films produced until payment is received in full,
upon which copyright is assigned to the client.

4.2
Any client-supplied footage, images or content must have full permission of the copyright holder,
and as such, Thunder and Lightning are indemnified against any future copyright
claims.

 

5. General

5.1
All prices are subject to VAT at the prevailing rate unless otherwise stated.

5.2
Time or price quotations are subject to change without notification, unless quoted in writing
and subject to a maximum guarantee of 2 months from the date written.
